What is estate planning?

Estate planning is the process of arranging for the management and distribution of your assets and property during your lifetime and after death. This typically includes drafting legal documents such as wills, revocable living trusts, powers of attorney, and advance health care directives. It also plans for living — your plan will help keep things running smoothly even if you become incapacitated.

Why is estate planning important in California?

California has some of the highest probate costs in the country. Without an estate plan, the State of California decides who inherits your assets — usually biological relatives — which may leave out people you want to receive things or give things to people you never intended. An estate plan also protects minor children from inheriting too early (they would receive everything at age 18 without a trust), and ensures your healthcare preferences and financial decisions are handled by someone you trust.

What is the difference between a will and a trust in California?

A will is a legal document that specifies how your assets will be distributed after death, but it must go through probate court and becomes a public record. A revocable living trust holds and manages your assets during your lifetime and distributes them privately after death — without court intervention. In California, a trust is generally preferred because it avoids the costly and time-consuming probate process.

Absolutely. Even though California recognizes your marriage, estate planning protects against family disputes, ensures your chosen family is included in your plans, avoids costly probate, and protects family harmony. An estate plan also includes critical documents like health care directives and powers of attorney that protect your rights regardless of marital status.

Do I need a real estate attorney when buying or selling a home in California?

While California does not legally require an attorney for real estate transactions, hiring one protects your interests significantly. A real estate attorney reviews your purchase or sale contract, identifies risks in the fine print, helps negotiate terms, reviews or prepares seller disclosures, and ensures your most important asset is protected. Most problems attorneys resolve could have been prevented if someone was there to spot potential issues early in the process.

What types of deeds are used in California real estate transfers?

The most common types of deeds in California include: Grant Deed (transfers ownership and guarantees the property is free of undisclosed claims), Quitclaim Deed (transfers any ownership interest the grantor may have but offers no guarantees), Interspousal Transfer Deed (transfers property between spouses), and Trust Transfer Deed (transfers property into or out of a trust). Each type has specific legal implications for ownership, taxes, and inheritance.

What happens if I die without an estate plan in California?

If you die without an estate plan in California, the state's intestacy laws determine who inherits your assets — typically biological relatives. This may leave out people you wanted to include, like a partner, stepchildren, or chosen family. Your estate will also go through probate, which in California can cost 4-7% of the estate value and take over a year. Minor children would inherit their share outright at age 18 with no protections or conditions.
